1. ACCEPTANCE OF TERMS & CONDITIONS

By downloading, accessing, or using the Autowash app (the "App") provided by Autowash Management LLC, you agree to comply with and be bound by the following Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use the App. 

2. USE OF THE APP

2.1. Eligibility: You must be of legal age to enter into a contract and have the legal capacity to use the App. If you are using the App on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

2.2. User Account: Some features of the App may require you to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. 

​

2.3. Prohibited Activities: You agree not to engage in any of the following activities while using the App: 

  • Violation of any applicable laws or regulations. 

  • Using the App for fraudulent or unauthorized purposes. 

  • Harassing, threatening, or harming other users or Autowash employees. 

3. MEMBERSHIP

3.1. Overview of Services: Autowash subscription-based memberships provide customers with the ability to wash based on the specific inclusions and restrictions of the selected level. For specific details of inclusions and restrictions per level, see www.autowashco.com/memberships, the App, or on-site signage. All member levels are restricted to up to one car wash per day, self-serve or automatic, unless otherwise specified.

3.2. Eligibility: In order to be eligible for participation in any Autowash membership level, you represent and warrant that you meet the following criteria: 

​

  • At least 18 years of age. 

  • Access to the Autowash app via a data-enabled smartphone device utilizing Apple iOS or Android. 

  • A valid method of payment for recurring charges. 

​​

3.3. Wash-N-Share Plan: The Autowash Wash-N-Share Plan allows you, the Member, to add up to 1 additional user to your account at a reduced rate from the full subscription pricing. By using the Wash-N-Share Plan, additional users who are added to your account will be able to use your membership, including the daily wash allowance. In addition to the daily wash, Wash-N-Share Plan users will be able to purchase additional washes. By adding Wash-N-Share Plan users to your membership account, you give them express permission to use the wash and/or pay for additional services using your payment method on file and you agree to be responsible for any transactions created by your Wash-N-Share Plan.

3.3.1. Daily Wash Limit: The Wash-N-Share Plan is subject to the 1 car wash per day, per membership limit. Each Wash-N-Share Plan user added to the account will have access to the use the car wash. That means that all members of the Wash-N-Share Plan share the single plan-included wash per day. Once the first member of the Wash-N-Share Plan uses the daily plan wash, the remaining users of the Wash-N-Share Plan will need to either purchase additional washes or wait until the following day to use the daily wash. The daily wash clock resets at 11:59 pm MST each night.

3.3.2. Additional Wash Purchases: Wash-N-Share Plan users will be able to purchase additional washes in a day at the current Member Pricing Discount of 25%. The addition of a Wash-N-Share Plan user to your Membership will result in a prorated increase in your monthly amount and will be calculated and presented to you before finalizing the transaction. Pay-Per-Wash transactions are also presented to the user with the discount applied before finalizing the transaction. Until the Purchase button has been selected, users may exit/cancel out of the process at any time by hitting the back button on their device or selecting a back arrow. No refunds will be given for pay-per-wash transactions.

3.3.3. Removing Users: You may remove a Wash-N-Share Plan user at any time and the fee will be automatically prorated by the payment processor. Users who already have a pre-existing subscription may not be added to the Wash-N-Share Plan while that subscription is active. Refunds will not be provided for canceled membership subscriptions under the normal terms and conditions of that membership.

3.3.4. Compliance: Each user is required to comply with the safety signage and app agreements whether displayed at the car wash or in the mobile app. The terms of the Wash-N-Share Plan are superseded by the overall Autowash Terms and Conditions already agreed to. 

​

3.4. Cancellation: You may cancel your membership at any time, subject to the terms specified in this cancellation policy. 

​

3.4.1. Cancellation Process: Memberships can only be caneled by speaking with an authroized Autowash representative via phone, text, or email. Cancellations will then be confirmed via email at the end of the billing cycle. To cancel your membership call or text (303)927-9061 or send an email to info@autowashco.com. If you are unable to reach a representative by phone, leave a message with your name, membership email, and phone number. Failure to provide accurate or complete information can delay the process of handling your cancellation request.

3.4.2. Cancellation Timing: Cancellations must be received prior to the renewal of the next billing date, otherwise you may be charged for that month and the canellation will not take effect until the next billing date. Email requests must be received at least 24 hours prior to the billing date in order to gaurantee teh canellation will be processed in time. The fastest and easiest way to ensure cancellation is to call and speak with an authorized Autowash Customer Success agent.

3.4.3. App Deletion: Deleting or uninstalling the app from your mobile device, changing carriers, phones, or phone numbers DOES NOT constitute a cancellation request per the Termination section of this document. Refunds will not be provided for users who delete the app and do not follow the cancellation process outlined above. 

4. CONNECTIVITY

4.1. Cellular or Data Connections: Autowash is not responsible for lack of cell phone coverage or connection limitations that may prevent use on any given day. Refunds or credits will not be provided due to poor cell phone connectivity or other personal device limitations.

4.2. Free Wi-Fi Access: At select locations, Autowash provides complimentary Wi-Fi access to our customers as a courtesy. This service is intended to enhance your experience, especially in areas where cellular signals may be weak. 

 

  • Access and usage are granted only by utilizing a verified email account and following the prompts. 

  • Customers are permitted up to one (1) hour of Wi-Fi use per day. 

  • The free Wi-Fi service is intended for personal use only and may not be used for commercial purposes. 

  • The service may not be used to engage in any unlawful or prohibited activities including, but not limited to downloading illegal content, engaging in fraudulent activities, or accessing inappropriate websites. 

  • While Autowash strives to provide a secure Wi-Fi connection, we cannot guarantee the security of your data while using the service. Users are advised to take necessary precautions and exercise best practices for the security of their personal information while connected to the public Wi-Fi network. 

  • The availability of free Wi-Fi may vary by location and is not guaranteed. Autowash reserves the right to modify, restrict, or discontinue the free Wi-Fi service at any time without prior notice. 

  • Autowash is not responsible for any loss or damage incurred as a result of using the free Wi-Fi service, including but not limited to data breaches, unauthorized access, or interruptions in service. 

5. PURCHASES

5.1. Product and Service Listings: The App may display products or services available for purchase. The descriptions, prices, and availability are subject to change without notice.

5.2. Payment Information: You must provide valid payment information to Autowash for purchases made through the App. You authorize Autowash to charge your chosen payment method for all applicable fees. 

​

5.3. Discounts and coupons: No refunds or credits will be provided for any discounts or coupons. Discounts and coupons have no cash value. Additional member benefits and offers, including free offers, are subject to availability and continued membership good standing. Some discounts may apply only to new users. Promotions that indicate a monthly price are deemed to be a dollar amount subtracted from the current membership pricing. For Lifetime discounts, the coupon or discount off the current membership pricing is forever; however, the base price is always subject to adjustments as necessary but not without notice.

5.4. Membership Use: Various membership plans are available for purchase through the app. As an Autowash member, you understand that your payment information will automatically charge each month until the Membership is canceled or terminated. Each month you will receive an email reminding you of the monthly membership. An email notification will also be provided if the amount changes, in which case Autowash will provide at least 30-days notice (but no more than 60-days) prior to payment being collected. Additional terms for membership are available in section 3 of this document.

5.4.1. Membership Refunds: If the membership has been used during the current billing period refunds will not be issued. Membership plans will remain in effect for the duration of the month once the membership fees have been collected. No refunds or credits will be will be given for partial periods or due to lack of use. 

​

5.5. Pay-Per-Wash Use: The Autowash Pay-Per-Wash feature is not part of the Membership, and purchases using this feature are not refundable. Members that use the Pay-Per-Wash feature acknowledge that they are choosing to purchase additional services beyond the daily allotment included in the membership and will be charged for each wash they purchase using the card on file.

5.5.1. Pay-Per-Wash Refunds: Retail purchased washes, either by member or non-member users, that complete as intended will not be refunded for any reason.

​

5.6. Loyalty Use Program: All customers, including subscription-based members and pay-per-wash retail users, are automatically enrolled in the Autowash Loyalty Rewards program upon completion of account setup within the app. Autowash Clean Credits are earned at a rate in relation to qualified in-app spending. Additional terms for the loyalty program are available in section 8 of this document.

5.7. Fleet or Commercial Use: The app may not be used for Fleet services without express permission from Autowash. Once permission is obtained, users must use the Fleet program within the app. Members of the fleet program should contact their company’s specific fleet manager for any issues with their account. It is the responsibility of the Fleet Manager to maintain the member list and authorize access of their Fleet Account. Additional terms for the Autowash fleet program are provided to the authorized Fleet Adminstrator at the time the Fleet Account is established.

5.7.1. Ride Share Use: Taxis, limos, app-based transportation services (including but not limited to Uber and Lyft), and other professional transportation vehicles may be limited. This standard membership is for individual use only and is not to be used for business purposes.

  

5.8. Order Confirmation: An order placed through the App constitutes an offer to purchase the product(s). Appropriate shipping information must be provided. Autowash reserves the right to accept or reject any order. Order confirmation does not signify acceptance of your offer.

 

5.9. Availability: Not all product offerings or services may not be available at all Autowash locations. Autowash reserves the right to close locations due to inclement weather, holidays, equipment maintenance, unforeseeable natural disasters, governmental requirements, location upgrades, or any other reason to maintain the facilities as a going concern. 

6. PRIVACY AND DATA SECURITY

6.1. Privacy Policy: This Privacy Policy (the "Policy") explains how Autowash LLC ("We" or "Us") collects, stores, uses, and discloses personal information ("Information") from our customers and end users (collectively "You") in connection with the iOS and Android mobile apps we develop ("Mobile Apps" or "Enterprise Service") as well as the website and Administrative Web Portal located at www.autowashco.com (the "Site"). 

Please read and make sure You understand this Policy. We may modify this Policy in the future, so please check back regularly for updates. We reserve the right to make revisions at any time, and the revisions will be effective upon our posting updates to this website. If You access a Mobile App developed by Us or the Site after a revision is posted, Your use will constitute acceptance of the revision.

6.1.1. Information Collected: This Policy applies to Information We collect from You but does not apply to any services or products offered by third parties and made available to You through our Mobile Apps and the Site. We obtain Information in the following forms: 

​

  • Information provided by You as part of registration 

  • Information that is obtained from Your use of the Mobile Apps and Website.

(i) Information provided by You: You may be required to register in order to access certain features of the Mobile Apps and Site. To become a registered user, You will be asked to create a personal account which may include Your name, login name and password, email address, phone number, and payment information. No sensitive payment information is stored, processed, or transmitted by Us; rather, a third-party payment processor (e.g., Stripe) handles these responsibilities enabling us to fall under the SAQ Category "A" for PCI compliance. 

​

(ii) Information from Your Use of the Mobile Apps and Site: We may automatically collect certain Information from Your use of the Mobile Apps and Site such as usage data, preferences, or any other data that includes Information concerning how You use the Mobile Apps and Site. In particular, We may collect the following types of Information: 

​

  • Your mobile phone and browser type, language, plug-ins, Internet domain, and operating system; 

  • Your Internet Protocol (IP) address; 

  • The website(s) You visited before visiting the Site and the website(s) You visited after visiting the Site; 

  • Unique identifiers including mobile device identification numbers that may identify the physical location of such devices; 

  • Data collected through cookies and other tracking technologies; and 

  • Data related to Your interactions with content on the Mobile Apps and Site such as the type of content viewed or favorited in the Mobile Apps and Site.

6.1.2. Use of Collected Information: We use Information collected from your use of the Mobile Apps and Site specifically to: 

  • Analyze, operate, and improve the Mobile Apps and Site and services offered thereon; 

  • Customize the content You see when You use the Mobile App; 

  • Customize the content on the Site; 

  • Enforce this Agreement; 

  • Conduct market analysis, traffic flow analysis; and 

  • For any other purposes disclosed to You at the time We collect Your Information.

We will not share or sell any of Your Information to any third party except as otherwise stated in this Policy and in the following circumstances: 

​

(a) In response to subpoenas, court orders, or legal process, to the extent permitted and as restricted by law; 

​

(b) When disclosure is required to maintain the security and integrity of the Mobile App and Site or to protect any user's security or the security of other persons, consistent with applicable laws; 

​

(c) When disclosure is directed or consented to by the user who has input the Information; 

​

(d) In the event that We go through a business transition such as a merger, divestiture, acquisition, liquidation, or sale of all or a portion of its assets, Your Information will in most instances be part of the assets transferred; or 

​

(e) In limited circumstances, We may disclose Your email address in order to comply with laws and regulations, including the Controlling the Assault of Non-Solicited Pornography and Marketing Act (CAN-SPAM Act of 2003). 

 

Please note that We may retain certain Information after Your account has been terminated. We reserve the right to use Your Information in any aggregated data collection after You have terminated Your Account; however, We will ensure that the use of such Information will not identify You personally.

6.1.3. Security of Information Collected: Information provided by You is protected by the login and password You create when registering to use the Mobile Apps or Site. Please understand that You can help prevent the unauthorized disclosure of Information by choosing and protecting Your password appropriately. You can also help prevent unauthorized disclosure by not sharing your password and preventing others from using Your computer or mobile device.

We use commercially reasonable procedures to protect all collected Information. Please understand that no security system is perfect and as such We do not guarantee the security of the Mobile Apps or Site or that Your Information won't be intercepted while being transmitted to Us. If We learn of a security systems breach then We may either post a notice or attempt to notify You by email and will take reasonable steps to remedy the breach.

Although the Mobile Apps and Site may contain links to third-party applications or websites, We are not responsible for the privacy policies and/or practices on those third-party applications or websites. Where We have linked to a third-party application or website, You should read the privacy policy stated on that third-party application or website.

6.2. Security: You are responsible for maintaining the security of your account credentials and ensuring the confidentiality of your account information. The app is per user and a user’s 1 (single) mobile device. Sharing login information across multiple devices is prohibited; no more than 1 device per user is permitted.

6.3. Consent to Receive Electronic Communications: Autowash or its affiliated companies (“we”) may need to provide you with certain communications, advertisements, notices, agreements, billing statements, or disclosures in writing (“Communications”) regarding your Membership or our other products or services. Providing your email address and accepting these terms and conditions confirms your ability and consent to receive Communications electronically rather than in paper form. You have the right to receive any Communication in paper form. To request a paper copy of any Communication at no charge, please write to us at 9525 E. 40th Ave, Suite 110, Denver, CO 80238, attention: Autowash App, specifying the Communication you would like to receive. You may withdraw your consent to receive electronic Communications at any time by writing to us at the address above. 

7. CONSENT TO RECEIVE ELECTRONIC AND AI BASED COMMUNICATION

7.1. Consent to Receive Calls and Messages: By downloading and using our app, you consent to receive calls, texts, and other communications from our company, including those made using artificial intelligence (AI) technologies. These communications may include, but are not limited to, service notifications, account updates, promotions, and customer support interactions. 

​

7.2. Purpose of AI Calls: Our AI-driven calls are designed to enhance your experience with our services by providing timely information and support. These calls may be used to inform you about new features, services, promotions, and to assist with customer support inquiries. 

​

7.3. Opt-Out Options: You have the right to opt out of receiving AI-driven calls and communications at any time. To opt out, please follow the instructions provided in the communication or contact our customer service team.

 

7.4. Privacy and Data Security: We are committed to protecting your privacy and personal information. All AI-driven communications will adhere to our Privacy Policy. Your data will be handled in accordance with applicable data protection laws and regulations.

7.5. Recording and Monitoring: For quality assurance and training purposes, AI-driven calls may be monitored and recorded. By using our services, you consent to such monitoring and recording. 

​

7.6. Compliance with Laws: We comply with all applicable laws and regulations related to telemarketing and communications, including but not limited to the Telephone Consumer Protection Act (TCPA) and other relevant state and federal laws. 

​

7.7. Changes to This Policy: We may update this AI Calling and Communication policy from time to time. We will notify you of any changes by posting the new policy on our website and app. Your continued use of our services after such changes will constitute your acknowledgment and acceptance of the updated policy. 

​

7.8. Autowash (“we”) may need to provide you with certain communications, advertisements, notices, agreements, billing statements, or disclosures in writing (“Communications”) regarding your Membership or our other products or services. Providing your email address and mobile number and accepting these terms and conditions confirms your ability and consent to receive Communications electronically, rather than in paper form. You have the right to receive any Communication in paper form. To request a paper copy of any Communication at no charge, please write to us at 9525 E. 40th Avenue, Ste 110, Denver, CO 80238 attention: Autowash App, specifying the Communication you would like to receive. You may withdraw your consent to receive electronic Communications at any time, by writing to us at the address above. 
 
7.8.1 Marketing Messages and Account Notifications via SMS - Autowash may send marketing messages. Marketing messages contain offers, promotions and deals related to Autowash services. Autowash may also send messages related to your account, including payment method updates and other account related information. Message frequency varies. 
 
7.8.2. Our marketing and account update text messages are intended for subscribers over the age of 16 and are delivered via USA short code 97412. Message and data rates may apply. 
 

7.8.3. Customer Service messages are sent from (303)927-9061. Message and data rates may apply. 
 

7.8.4. This service is available to persons with text-capable phones subscribing to carriers including AT&T, Verizon Wireless, T-Mobile®, Sprint, Virgin Mobile USA, Cincinnati Bell, Centennial Wireless, Unicel, U.S. Cellular®, and Boost. for help, email info@autowashco.com, or call +1 3039279061. 
 

7.8.5. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. 

 

7.8.6. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@autowashco.com or call 303-927-9061. 

 

7.8.7. Carriers are not liable for delayed or undelivered messages. 

 

7.8.8. As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, it is best to contact your wireless provider. If you have any questions regarding privacy, please read our privacy policy 

8. LOYALTY PROGRAM

8.1. Program Eligibility and Overview: The Autowash Loyalty Rewards (“Program”) is offered at the sole discretion of Autowash LLC (“Autowash” “we” “our” or “us”). The Program is available to individuals for their personal use only and is limited to one account per individual. Corporations, associations, or other groups may not participate in the Program, including Fleet customers. Individuals who are residents of the United States (including its territories and possessions) and at least 18 years of age or older and can provide and maintain a valid email address are eligible to participate in the Program. 

​

8.2. Program Enrollment: All customers, including subscription-based members and pay-per-wash retail users, are automatically enrolled in the Autowash Loyalty Rewards program upon completion of account setup within the app. 

​

8.2.1. You are required to provide your first name, last name, valid email address, and mobile number upon enrollment into the app. This information will be associated with your Loyalty Program profile automatically. You may also have the opportunity to provide us with your mailing address and birth date, but this information is optional. You are solely responsible for maintaining the accuracy of your account information and for updating it as required. 

​

8.2.2. By opting out of communications at any time, you acknowledge that you may not receive up-to-date information about changes to the Program, including but not limited to points expiration and rewards tier changes. 

​

8.2.3. Only one Program account may be associated with a single email address or mobile number. 

​

8.3. Earning Loyalty Credits: Autowash Clean Credits (“Credits”) are earned at a consistent rate of 1 credit per dollar spent in the app, excluding taxes. In-app spending is qualified as any monetary transaction which occurs within the Autowash app, including single wash purchases, recurring membership fees, wash add-ons, etc., billed to the payment method on file within the Autowash app. 

​

8.3.1. Alternatively, Credits can be earned when redeeming dollars previously loaded at the Account Management Station at any cashless Autowash location. The earning rate of 1 Credit per dollar will be applied at the time the dollars are used for purchases. 

​

8.3.2. All other transactions which occur outside of the app are not eligible to earn Credits. 

​

8.3.3. Autowash reserves the right to apply Credits to a customer account in non-transactional promotional activity (i.e., Receive 50 Autowash Clean Credits for attending an Autowash car show). 

​

8.3.4. Autowash reserves the right to adjust Credit balances negatively in the event of fraud, misuse, misrepresentation, negligence, or in the event of behaviors or actions which are deemed detrimental or damaging to Autowash, our properties, or employees. 

​

8.4. Redeeming Autowash Clean Credits: Autowash Clean Credits are available for redemption exclusively within the Autowash app. Credits do not translate to cash value outside of the Autowash app and are non-transferrable. 

​

8.4.1. Credits expire 12 months from the date of the purchase transaction in which they are earned unless otherwise specified. Unused or expired credits cannot be retrieved, refunded, and are not eligible for any compensation. It is the sole responsibility of the user to monitor their Credit balance and redeem it prior to expiration.

 

8.4.2. Credits are available for redemption in a graduated tier system that may include but is not limited to account credits or physical merchandise. Autowash reserves the right to adjust redemption tiers at any time per the terms outlined in section 1.2 of this document. 

​

8.4.3. From time to time, Autowash may run promotions that increase, alter, or accelerate redemption rewards, tangible or intangible, and may run the promotions for limited times, otherwise known as ‘Ad hoc’ promotions. Autowash reserves the right to add or remove the Ad hoc promotions without notice. 

​

8.4.4. Rewards cannot be exchanged or returned for refunds or other monetary considerations. 

​

8.4.5. Rewards and/or Credits earned through the Program carry no additional cash value, are non-transferable, and grant the customer no additional benefit beyond that which is described in the program at the time of Credit redemption. 

​

8.4.6. Rewards expressed as a fixed value (i.e. - “FREE MONTH”) are associated specifically within the membership and corresponding reward tier. These credits will apply the the accounts in-app wallet and can be used for upgrades, add-ons or will be automatically applied to the recurring membership fee at the next billing cycle unless the member has opted out of automatic credit application in the app. 

​

8.5. Program Communications: By participating in the Program, you will be automatically subscribed to receive and consent to receiving Autowash marketing emails and Program details. 

​

8.5.1. You may opt-out of receiving Autowash marketing emails at any time by following the instructions provided in the email or as otherwise provided in the Autowash Privacy Policy. Regardless of subscription status, you will be sent operational communications as it pertains to your participation in the program until such time your account is closed in full. Examples of these communications include but are not limited to redemption confirmation emails, points acquired emails, profile or security update emails, or other communications related to the operation of your account. 

​

8.5.2. You may opt-out of receiving Autowash marketing texts at any time by replying STOP to any of the messages received. Opting out of text-based communications limits program updates to email. This may impact awareness of promotions or loyalty credit-earning opportunities. 

​

8.5.3. If at any time after opting out of Autowash text-based or email communications, you may opt back into communications by contacting our offices and requesting to receive communications. Requests must be received in writing and expressly indicate that you wish to receive communications from Autowash at the provided points of contact in section 15 of this document. 

​

8.6. Termination and Modification: The Program and its benefits are offered at the sole discretion of Autowash. We may, in our discretion, cancel, modify, restrict, or terminate these Program Terms and/or the Program or any aspect or feature of the Program at any time without prior notice, even though such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits.

8.6.1. Autowash reserves the right to exclude you from or to discontinue your participation in the Program and to audit your Loyalty Program account at any time in our sole discretion. Any suspected abuse of the Program, failure to follow any Program Terms, illegal activity, fraud, misrepresentation, or other conduct inconsistent with these Program Terms and/or detrimental to us or our interests, including without limitation any suspected illegal, fraudulent, or other unauthorized use of any Program rewards, points, cards, credits, vouchers, coupons, and/or certificates may result in the revocation of your account and make you ineligible for further participation in the Program. If your participation is revoked, any rewards or benefits in your account will automatically expire and your access to the Program and features will automatically terminate. If we suspect illegal activity, fraud, misrepresentation, abuse, or violation of these Terms, we also have the right to take appropriate legal action in our sole discretion.

8.7. Indemnification and Limitation of Liability: You agree to defend, indemnify, and hold Autowash, subsidiaries, affiliates, partners, licensors, officers, directors, employees, and agents harmless for any loss, damages, or costs, including reasonable attorneys' fees, resulting from any third-party claim, action, or demand resulting from your participation in the Program in violation of any law, rule, regulation, or these Program Terms.

8.7.1. Autowash is not responsible for any loss, injury, claim, liability, or damage related to your participation in the Autowash Loyalty Program.

8.7.2. You and Autowash agree that any dispute, claim, or controversy arising out of or relating in any way to the Autowash Loyalty Rewards Program or your participation therein shall be determined by binding arbitration instead of in courts of general jurisdiction.

8.7.3. These terms and conditions are governed by and construed in accordance with the laws of the State of Colorado.

8.8. Privacy: The personal information collected from you in connection with the Program, including but not limited to purchases made in connection with your Program participation, will be used and disclosed by us in accordance with the Autowash Privacy Policy. You are entitled to receive a record of your Program transactional history at any time. To receive a complete transaction history, you must provide your request in

writing via the contact channels outlined in section 9 of this policy. Allow 7 to 10 business days for processing of your request.

9. VEHICLE ATTACHMENTS AND SAFETY

9.1. Overview: Autowash Contouring uses optic sensors to follow the shape of a vehicle to maximize the effectiveness of the wash cycles. By keeping the wash closer to the vehicle, we are able to apply a better rinse and dry experience. The Contour Dry follows the main body of the vehicle. We use 99.995% mineral-free water to prevent spotting after a rinse, and the dryer will remove approximately 98% of the water on the vehicle after the wash. It is recommended to towel off the vehicle after the wash as needed for any drops of R.O. water that remains.

9.2. Warning for Attachments: If you have attachments on your vehicle that extend beyond 6 inches from the main body of the vehicle, you must only use the Essential Wash. If you use any other wash package with attachments (factory or aftermarket), you are liable for any damage caused to the automatic machinery. ANY items that extend 10 inches from the vehicle may NOT be washed in the Automatic Wash at all.

9.2.1 Autowash is not responsible for damage caused to vehicles when machines are working properly. This includes guide rails. It is your responsibility to ensure you are in control of your vehicle at all times, including driving into and out of the wash bay. Guide rails are designed like a curb to protect the machine from being hit by a vehicle. This warning and these images are not exclusive. There are hundreds of attachments and customizations in the market for today's vehicles; many have manufacturer warnings that specifically warn against car wash use. Autowash is not liable for damage caused by attachments on vehicles. You may be liable for damages caused to the car wash for failure to follow this warning and warnings at each location used. 

9.3. Specific Attachment Restrictions: If you have any Roof, Rear, or Front bumper accessories, you may ONLY use the Essential Wash Level or Self-Serve. Customers using any other wash level will be held liable for damage to the Automatic Machine. This includes Jeep Rear Tires, Rear Spoilers, Ladder Racks, Bike Racks, Headache Racks, etc. Anything that exceeds 6 inches from the main body of the vehicle is considered an Attachment. Items that exceed 10 inches from the main body of the vehicle may NOT be used in ANY automatic wash. This includes hitch-mounted bike racks, handicap carriers, oil or fuel pumps, fly-rod cases, etc. 

 

Autowash is not responsible for damage to vehicles caused by this machine when this warning is ignored. Autowash is not responsible for any damage caused by the customer driving into curbs, guide rails, or other fixtures as a result of the vehicle moving or parking incorrectly.

10. CHANGES TO TERMS AND APP

Autowash reserves the right to change these Terms and the App at any time with notice to you. Continued use of the App after such changes constitutes your acceptance of the modified Terms. 

11. TERMINATION

11.1. Membership Cancellations: Deleting or otherwise removing the app from your mobile device is NOT considered a cancellation request for memberships. Refunds will not be provided for users who simply delete the app and do not follow the cancellation process outlined in the membership terms and conditions.

 

11.2. Autowash Service Termination: Autowash reserves the right to terminate or suspend any products, offerings, or services available in the app at any time and for any reason.

11.3. Autowash App Termination: Autowash reserves the right to terminate or suspend your access to the App at any time for violations of these Terms or for any other reason determined by Autowash.

12. DISCLAIMER OF WARRANTIES

12.1. APP Warranties: The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

12.2. READ AND OBEY ALL PHYSICAL AND DIGITAL SIGNAGE! Users are responsible for taking care to observe all caution signs and warnings at Autowash locations, including but not limited to signage regarding automobile accessories and attachments, potential slippery conditions, directional signs, etc. Users will be held liable for damage caused to Autowash locations for failure to obey all signage. Failure to comply with site signage will result in immediate cancellation of membership and/or restriction from any Autowash facility. 

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Autowash shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages or any loss of profits or revenues arising out of or related to your use or inability to use the App. 

14. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the said courts and you consent to the personal jurisdiction of such courts.
